The hearing of the case challenging the controversial deal between the Kenyan government and Indian conglomerate Adani Group regarding operations at Jomo Kenyatta International Airport (JKIA) has been postponed to November 27, 2024.
Wiper Party leader Kalonzo Musyoka confirmed on Monday that the case, initially set to be heard that day, was adjourned as the presiding judge was unavailable.
“The court sitting today has been pushed to November 27. There was a virtual sitting on the other matter filed by the LSK and the representative of the civil workers union,” Kalonzo said.
“We will return to the Milimani High Court Nairobi on November 27, 2024.” Kalonzo added.
Kalonzo reiterated the petitioners’ stance against the deal, stating that they are committed to preventing the government from finalizing the agreement with Adani Group, citing concerns over transparency.
He noted that the deal raised serious questions, highlighting the Indian company’s involvement in multiple sectors of Kenyan infrastructure projects, such as the Kenya Electricity Transmission Company (KETRACO) and the State Health Insurance Fund (SHA/SHIF), all shrouded in what he described as “secrecy.”
“We have said this before: that we have no problem with investors coming into the country. However, the way this Adani deal has been crafted has all the trappings of what one would call state capture,” Kalonzo said.
“Look at Adani in JKIA. Adani in SHA/SHIF. Adani in KETRACO. All these deals are clouded in secrecy.” He added.
