Two Members of County Assembly (MCAs) are facing legal action in separate incidents involving theft and misuse of a firearm, according to the Directorate of Criminal Investigations (DCI).
In the first case, Cyrus Musyoka Kisavi, the MCA for Ikanga Ward in Kitui County, was arrested in Nairobi on Tuesday afternoon over allegations of stealing mobile accessories worth Ksh.1.9 million.
The items were reported stolen by Buscar Courier Services on February 8, 2025. DCI detectives said Musyoka was captured on CCTV collecting a parcel meant for a client in Mombasa. The footage was positively matched to him, prompting a search.
Musyoka was later spotted at the courier’s River Road offices, where he allegedly failed to disclose his identity as an elected leader. Security personnel detained him and handed him over to Central Police Station officers. He was later identified and transferred to Mombasa for further investigation.
In a separate case, Stephen Rais Kisemei Marush, the MCA for Oloosirkon Ward in Kajiado County, was arraigned and charged with three counts — misuse of a firearm, obstruction of a police officer, and creating a disturbance.
According to the DCI, the charges stem from an incident on December 4, 2023, when police officers attempted to arrest suspects involved in an assault and malicious damage case in Ngurunga, Emakoko.
While one suspect was successfully arrested, the situation escalated when Kisemei reportedly arrived at the scene accompanied by more than ten individuals armed with sticks and knives. The group allegedly assaulted the officer guarding the suspect and forcibly freed him.
The MCA, who was reportedly armed with a pistol, also led the group in attacking a police vehicle and threatening officers.
Detectives from DCI Isinya later took over the investigation, and the Office of the Director of Public Prosecutions (ODPP) approved charges against Kisemei following a review of the case file.
Both cases are now active in court as authorities pursue justice and accountability.
