David Nderitu Ndumo, the controversially installed Treasurer of the Presbyterian Church of East Africa (PCEA) is in deeper problems after the Cooperative Tribunal sitting in Nairobi gave a notice of show cause why he cannot be committed to civil jail.
Mr. Ndumo, had in various occasions took loans totaling to Sh 5.8 million from Sheria SACCO but failed to repay prompting his 15 guarantors to take him to the tribunal in 2019 to get him pay.
The monies have since accrued interest and in addition to Court collection fees among other charges, the tribunal has ordered him to pay a total of Sh 8,326,042.46 before January 23rd next year, failure upon which he will be sentenced to serve term in jail.
“This is to give you notice that you are to appear before this court on the 23rd day of January 2025 at 9.00 am O’clock, in the forenoon in person or by an agent duly authorized and instructed to show cause, if any, why execution should not be granted,” read the terse notice signed by the Deputy Registrar of the Cooperative Tribunal.
Mr. Ndumo had been asked to pay up by the tribunal after a successful litigation by the guarantors sometime mid this year, but he moved to court to seek for time.
He has since failed to make the payment forcing the tribunal to finally give this notice to show cause early next year.
Speaking upon this notice signed on December 9, 2024, the guarantors counsel Wanjohi Wambugu registered how his clients were pleased with the verdict saying justice has finally been served.
PCEA Church supremos Moderator Thegu Mutahi and Secretary General Robert Waihenya are facing a contempt of court charges after installing David Ndumo despite a court order barring them from doing so.
The duo have their day in court just two days before Mr Ndumo face the court with possible civil jail sentencing.
