Kenya Enacts New Regulations on Toxic and Hazardous Chemicals

The National Environment Management Authority (NEMA) has issued a public notice regarding the mandatory registration of toxic and hazardous industrial chemicals and materials. The new regulations, established under the Environment Management and Coordination Act (CAP 387), are set to streamline the management of hazardous substances in the country.

The Environment Management and Coordination (Management of Toxic and Hazardous Chemicals and Materials) Regulations became law through a Kenya Gazette Supplement No. 199, dated November 4, 2024. These regulations cover all aspects of toxic and hazardous chemicals, including their manufacture, import, export, distribution, transport, storage, handling, and disposal.

According to the notice released on Thursday 13th, any individual or company intending to import, export, manufacture, distribute, or supply toxic and hazardous industrial chemicals and materials must apply for registration in compliance with Regulation 8 of the new law. Failure to adhere to these guidelines will be considered an offense under CAP 387 and its related regulations.

NEMA has advised stakeholders to visit its official website (www.nema.go.ke) for detailed requirements regarding the registration process. The move is aimed at ensuring environmental safety and public health by regulating potentially harmful substances within Kenya’s industrial sector.

The Director General of NEMA reiterated the importance of compliance, emphasizing that proper management of these chemicals is crucial in preventing environmental degradation and health risks.

This development aligns with Kenya’s commitment to sustainable environmental practices and adherence to Vision 2030, reinforcing regulatory measures to safeguard both the ecosystem and public well-being. Authorities have warned that non-compliance will result in legal action, urging businesses and individuals dealing with such chemicals to register without delay.
