The Judicial Service Commission (JSC) has acknowledged receiving a petition from former Law Society of Kenya (LSK) President Nelson Havi, seeking the removal of Chief Justice Martha Koome and several other judges from office.

In a statement issued on Thursday, January 16, the JSC confirmed that the petition, dated January 10, 2025, also targets Deputy Chief Justice Philomena Mwilu and five Supreme Court judges, accusing them of gross misconduct.

“The JSC acknowledges receipt of a petition filed by Mr. Nelson Havi against Lady Justice Martha Koome, Lady Justice Philomena Mwilu, Justice Mohammed Ibrahim, Justice Dr. Smokin Wanjala, Lady Justice Njoki Ndung’u, Justice Isaac Lenaola, and Justice William Ouko,” read part of the statement.

The commission assured the public that the petition will be addressed in accordance with the established procedures and the rule of law.

“Complaints filed will be dealt with in line with the processes and procedures developed under the Constitution, as well as the Fair Administrative Action Act,” JSC added.

The JSC reiterated its commitment to protecting the independence of the judiciary while holding it accountable. The commission disclosed that, since its establishment, it had received 935 petitions against judges between 2011 and 2024.

“Of the 935 petitions and complaints received, 862 have been finalized, with 12 forwarded to the President recommending the formation of a tribunal for removal. The remaining 73 petitions are at various stages of processing,” JSC stated.

Since the beginning of 2025, the commission reported receiving a total of five petitions against judges, including the latest one filed by Nelson Havi.

The JSC emphasized its resolve to uphold its constitutional mandate while ensuring fairness and accountability in addressing the complaints.
