The beleaguered PCEA Church leaders Moderator Rev Thegu Mutahi and his colleague Secretary General are still in trouble as the case of contempt of court has been
PCEA clerics contempt of court case now repostponed to January 21 next years after the judge listening to the case has been transferred by the Chief Justice.
The two defied court orders in April barring them from installing elder David Nderitu Ndumo as the Honorary Treasurer of the Church.
The orders had been issued by lady Justice Asenath Ongeri who has since been transferred to a new duty station in Voi granting an injunction to Ndumo’s installation until a matter before the Cooperative Tribunal involving the latter with failure to pay a SH 5.8 loan from sheria SACCO that had since accrued interest as is now Sh 7.6 million.
“We will make sure that we get the entire amounts including interest to offset deductions from my clients and victims of Rev. Ndumo as well as all interest accruing so that we settle this matter once and for all,” said the lawyer for the guarantors Mr. Wambugu Wanjohi.
Mr Ndumo had been taken to the tribunal by 15 guarantors who had suffered immensely after they got forceful deductions from their pays lips in a bid to recover the loan taken by him.
Whilst giving those orders, Justice Ongeri then said court orders must be respected and that she was going to mete appropriate punishment to those defying court orders so as to serve as a lesson.
The duo is in court after a faithful, Benjamin Mburu moved to court in a petition to have them sanctioned for going ahead with the installation after refusing to be served by a court server during an installation ceremony attended by both President William Ruto and his former Deputy Rigathi Gachagua.
During an online court session Tuesday, Lady Justice Tabitha Wamalwa announced that she was not able to proceed with listening to the case due to directives by the Chief Justice for her to proceed on transfer.
“As it is, this court may not start hearing a new matter going with the directions of the Chief Justice because I am proceeding on a transfer. There is no need for me to start to proceed with this process because I will not be able to complete it before I go on transfer,” she announced as she prepared directions.
In their defense, the two clerics had said they couldn’t allow to be served allegedly because the guests who had attended the installation.
But Lawyer Andrew Mochu, Tuesday, had been armed to display a video depicting how Rev Thegu Mutahi loudly refused to accept to be served even as veteran PCEA prelate Rev. Timothy Njoya walked out in protest.
